Terms of Service

1. Acceptance of Terms

By accessing or using the AI Readiness Diagnostic and related services (the “Service”) provided by Unpromptable (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

2. The Service

The Service generates a personalized readiness report based on the answers you provide. The report and any follow-up chat responses are produced in part by automated AI systems. They are provided for informational purposes only and do not constitute business, legal, financial, or other professional advice.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that any information you submit is accurate.

4. Your Content

You retain ownership of the answers and other content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display that content as needed to operate and improve the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or deceptive purpose.
• Attempt to reverse-engineer, scrape, or disrupt the Service.
• Submit content that is false, infringing, or that you do not have the right to share.
• Use the Service to build a competing product or model.

6. Intellectual Property

The Service, including its scoring methodology, prompts, report templates, code, and branding, is owned by Unpromptable and protected by applicable intellectual property laws. Nothing in these Terms grants you a license to our marks or materials except as needed to use the Service.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the outputs will be accurate, complete, or suitable for any particular purpose. You are responsible for how you act on the information we provide.

8. Limitation of Liability

To the fullest extent permitted by law, Unpromptable and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the prior twelve months, or (b) one hundred U.S. dollars.

9. Changes to the Service and Terms

We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes, we will update the effective date above and, where appropriate, notify you through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Provisions that by their nature should survive termination (for example, intellectual property, disclaimers, and limitation of liability) will continue to apply.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Unpromptable is established, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer-protection law.
